Terms of Service

1. The service

ReadyHermes hosts a dedicated instance of Hermes Agent, the open-source AI agent created by Nous Research, for each account. You can chat with it in your browser and, if you choose, connect it to messaging apps. ReadyHermes is an independent service and is not affiliated with or endorsed by Nous Research.

2. Your account

• You must be at least 18 years old and able to enter into a binding contract.
• Give us accurate information, keep your password secure, and tell us promptly if you think your account has been compromised. You are responsible for activity on your account.
• One account per person. Accounts created in bulk or to get around limits may be removed.

3. Free plan and fair use

ReadyHermes is free to start. To keep the service available for everyone we apply usage limits, which may include limits on messages, AI model usage, storage and scheduled tasks, and we may pause agents that are inactive for long periods. We may change the free plan, its limits, or introduce paid plans. If we introduce charges, we will tell you in advance and you will never be charged without agreeing first.

4. Acceptable use

You must not use ReadyHermes, or ask your agent, to:

• break any law or infringe anyone's rights, including intellectual property and privacy rights;
• create, store or share child sexual abuse material, or content that sexualises minors;
• harass, threaten, defraud or impersonate others, or spread malware or phishing;
• send spam or unsolicited bulk messages, including through connected messaging apps;
• attack, probe or overload our systems or anyone else's, or try to access data or accounts that are not yours;
• mine cryptocurrency, run proxies or other workloads unrelated to using your agent;
• resell or share access to the service, or get around usage limits;
• generate content intended to make critical decisions about people (such as credit, employment or housing) without human review.

You must also follow the terms of any messaging platform you connect your agent to.

5. Your content

You own the content you send to your agent and the output it creates for you, to the extent the law allows. You give us permission to host, process and transmit that content only as needed to run the service for you, including sending it to AI model providers as described in our Privacy Policy. You are responsible for having the rights to the content you provide.

6. AI output

Your agent's replies are generated by AI and can be inaccurate, incomplete or out of date. Check important information yourself and do not rely on the output as professional advice, for example legal, medical or financial advice. You are responsible for how you use the output and for actions you ask your agent to take.

7. Third-party services

The service relies on third parties, including AI model providers, search engines and the messaging apps you connect. Their availability and behaviour are outside our control, and their own terms apply when you use them. Hermes Agent itself is open-source software provided under its own licence.

8. Availability and changes

We work to keep ReadyHermes running around the clock, but we do not guarantee it will be uninterrupted or error-free. We may update, change or discontinue features, including the version of Hermes Agent we run. If we discontinue the service entirely we will give you reasonable notice so you can export your data.

9. Suspension and termination

You can stop using ReadyHermes and delete your account at any time from your account settings. We may suspend or close accounts that breach these terms, create risk or legal exposure for us or others, or have been inactive for an extended period. Where reasonable we will tell you first and explain why.

10. Disclaimers and liability

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these terms.

We are not liable for indirect or consequential losses, or for loss of profits, revenue, data or goodwill. Our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and £100.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence or for fraud, and nothing affects your statutory rights as a consumer.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK or in the EU, you also keep the protection of the mandatory laws of your country and may bring proceedings there.

12. Changes to these terms

We may update these terms. We will change the "last updated" date and, for significant changes, notify you by email or in the product before they take effect. Continuing to use ReadyHermes after that means you accept the updated terms.
